ADMISSION
A completed Registration and Agreement Form and Registration Fee and Deposit are required to secure your child’s place.
REGISTRATION FEE AND DEPOSIT
The Registration Fee is a one-off payment and non-refundable.
The Deposit will be forfeited in the event of a withdrawal after you have confirmed by signing below
The Deposit will be refunded by the 21st day of the following month of your child’s leaving date strictly subject to a minimum period of three months attendance and a minimum one month’s written notice of termination from you.
The Registration Fee is payable on the re-registration of any child after termination for any reason whatsoever.
COMMENCEMENT
There will strictly be no deferment in the commencement date once payment has been made and we have confirmed a place for your child.
Pausing of classes and refund of School Fees are strictly not allowed.
FEES AND INVOICES
Full payment of three months of School Fees in advance are required before the commencement date.
School Fees are payable in advance and are not refundable and non-transferable.
Material Fees are also payable before the start of each Term.
Payment may be made by standing order, cash, cheque or bank fund transfer made payable to “Baby Atelier Childcare Centre Sdn Bhd” Public Bank Berhad (Account number 319 – 212 -– 4506).
Invoices will be issued in the 1st week of the month preceding the start of each Term and will be due for payment on the 26th of the preceding month.
A charge of RM50.00 will be charged for late payment of fees and late payment interest of 3% per month on the outstanding sum from the 27th of the preceding month until full payment thereof.
Baby Atelier reserves the absolute right to withdraw your child’s place at the school in the event of failure to pay the School Fees after the due date.
A sibling discount is given based on the School Fees of the eldest enrolled child. Sibling discount is 5% for the second child and 2% for the third child onwards. All discounts are applied to the School Fees only and do not apply to extra sessions, Material Fees, meals or other services.
All School Fees must be paid for regardless of child’s attendance.
No refunds are given for sessions missed due to sickness or holidays or unavoidable nursery closure.
Please take notice that the number of days childcare provided each month may vary.
If you expect to be late collecting your child, please notify Baby Atelier as soon as possible. The additional time will be charged at the rate of RM50.00 per half hour or part thereof to cover emergency staffing and other cost and arrangements.
In case of default on any payment, we reserve our full rights to bring a legal claim in court at your cost and expense.
We reserve the right to review our fees and charges subject to at least one month’s notification in writing to you by letter or email to the address provided above. All School Fees and Material Fees are subject to an annual inflationary adjustment of 5%. A price increase of 10% will take place every 2 years.
OPENING TIMES AND SCHOOL TERM
Baby Atelier runs from 07:30 to 19:30. Baby Atelier is closed on Saturdays, Sundays, gazetted public holidays in Kuala Lumpur and declared school holidays.
Each school year is divided into quarterly terms, namely, January to March, April to June, July to September and October to December (hereinafter each quarter shall be referred to as a Term”).
CONTACT DETAILS
You must also provide Baby Atelier with up-to-date contact details for yourself and for any person authorised by you to make contact with Baby Atelier concerning your child or to pick up your child from Baby Atelier. If there is any Court Order or signed custodial agreement relating to any care/custodial arrangements for your child, you must provide a copy to Baby Atelier.
TERMINATION, CANCELLATION AND CHANGE OF SESSIONS
One month notice is required by either party for termination of this Agreement. If you choose to leave before the end of a Term, the School Fees are non-refundable. The minimum period of notice for any permanent change to full day or half day sessions is three months. If you change the notified Commencement Date, we reserve the right to charge from the original Commencement Date notified on the Agreement form.
Baby Atelier reserves the absolute right to terminate the Agreement with immediate effect in case of non-payment of fees, or if a parent, carer or child displays abusive, threatening or otherwise inappropriate behaviour, or for any other reasonable cause. Intimidation or abuse of our staff will not be tolerated and may result in immediate termination. In all other cases the standard notice period of one month will apply.
CLOSURE OF BABY ATELIER DUE TO FORCE MAJEURE
If by reason of Force Majeure (hereafter defined) that Baby Atelier is unable to perform its obligations, either in full or part, then upon written notice to the parents as soon as reasonably practicable after the occurrence of the Force Majeure, Baby Atelier shall not be liable and shall be released from any obligations to the extent to which they are affected by the circumstances of Force Majeure and for the period during which those circumstances exist. In such a situation, Baby Atelier may in its absolute discretion choose to continue by providing online learning to students, wherever possible and practicable to do so without any liability therefore.
“Force Majeure” herein includes and shall not be limited to any of the following events: war, invasion, terrorism, sabotage or arson; act, order or regulation of Government; earthquakes, fire, lightning, storms, floods or any other occurrence caused by the operation of the forces of nature; haze or very unhealthy pollution; prolonged electrical outage; strikes, lockouts, labour disputes; pandemic, epidemic or outbreak of any infectious disease; lockdowns, movement control order, compliance with any law or governmental order, rule, regulation or direction or any other event similar to any of the foregoing or any other event beyond the reasonable control of Baby Atelier.
1. Baby Atelier will not refund any School Fees or be in breach of this agreement or otherwise liable to you by reason of any delay in performance or non-performance of its obligations due to any Force Majeure Event.
2. In the event of the occurrence of a Force Majeure causing the forced closure of Baby Atelier and Baby Atelier chooses to provide online learning, all students will transition to virtual classrooms for students aged 2½ years and above. In such event, a rebate of 10% on the School Fees for students aged 2½ years and above for meals will be granted. A 50% rebate on the School Fees will be granted to students below 2½ years of age as they are too young for virtual lessons.
3. In the event that Baby Atelier is open and you choose to not send your child; or online classes are provided but your child does not attend online, the School Fees paid or payable will not be pro- rated or refunded or rebated or waived.
INSURANCE
Baby Atelier has insurance cover for public liability. Details of the insurance may be requested from the Branch Manager.
PERSONAL PROPERTY AND BELONGINGS
Baby Atelier cannot be held responsible for any loss or damage to any parent’s, carer’s or child’s property or belongings. Every reasonable effort will be made by Baby Atelier’s staff to ensure that property or belongings of any parent, carer or child is not damaged. Please ensure your child’s clothing and items are clearly labelled and we suggest that all toys, books and equipment are left at home.
LIABILITY
Baby Atelier excludes all liability for any losses suffered by you/parent/guardian arising directly or indirectly, as a result of Baby Atelier being temporarily closed or the non-admittance of your child to Baby Atelier for any reason. We accept no responsibility for children whilst in the care of yourself/a person authorised by you on Baby Atelier’s premises. We will not be liable to you and/or your child for any economic loss of any kind, for damage to property, for any loss resulting from a claim made by any third party or for any special, indirect or consequential loss or damage of any kind.
EMERGENCY AND ILLNESS
Baby Atelier reserves the right to administer first aid and any emergency treatment to your child as required. The contact person as stated in the Form will be informed of all accidents and you will be asked to sign an Accident Record form. If emergency treatment at hospital is required, Baby Atelier will make all reasonable attempts to contact the contact person/parents but if this is not possible, we are authorised to act on your behalf and authorise any necessary emergency treatment. We will administer prescribed medicines only if you have completed a Medicine Consent form.
We may require parents to withdraw their child from the school in the event that they require special medical care or attention which is not available or refused by the parent, or it is considered that the child is not well enough to attend the school. We may also ask parents to withdraw their child from Baby Atelier if we have reasonable cause to believe that the child is suffering from or has suffered from any communicable disease or infection and there remains a danger that other children may contract such a disease or infection. Please refer to our Sickness and Infection Control Policy regarding exclusion and incubation periods by which we are bound. Parents must inform Baby Atelier if the child is suffering from any illness, sickness or allergies before attending school.
No child may attend the school if they are suffering from flu, sickness, diarrhoea, an infectious illness or have any non-specific rashes until they are symptom free. Your child must remain away from the school for 48 hours from their last bowel/ sickness episode or cleared to return to Baby Atelier by a doctor to ensure that they are no longer contagious and are back to full health. If the child has COVID-19 or contagious disease or is a close contact, he or she must stay away from the school according to the standard operating procedure set by the Ministry of Health or until he or she is medically certified as no longer contagious, as is necessary.
PERSONAL DATA PROTECTION
Personal Data will be protected in accordance with Personal Data Protection Act 2010.
NOTICES AND COMMUNICATIONS
All general notifications and communications shall be by messaging on the School2Me App; or by WhatsApp / call on
+6013-350 0109 and your mobile number provided above. Each party shall update the other party in the event of a change of address and mobile number immediately.
Any legal notices shall deem to have been served if delivered by hand, at the time of delivery; or by registered mail in the ordinary course of posting.
AGREEMENT
The Registration and Agreement Form (including these Terms and Conditions) are legally binding on Baby Atelier and you and represent the entire agreement and understanding between you (including other carers) and Baby Atelier. Any other understandings, agreements, warranties, conditions, terms and representations, whether verbal or written, expressed or implied are excluded to the fullest extent permitted by law. We reserve the right to update / amend these Terms and Conditions at any time. One month notice will be given of any changes made by letter or email to the address provided above.
